The penalties for OUI in Massachusetts are substantial.  Upon a finding of culpability, the law imposes administrative penalties that impose license restrictions and ignition interlock requirements and criminal penalties.

First (1st) Offense OUI

·         Imprisonment for up to 2½ years.

·         Fines can range from $500-$5,000.

·         One (1) year suspension of driver’s license by court.

·         DMV suspends license thirty (30) days.

·         License reinstatement costs $50-$1,200, depending on circumstances.

Second (2nd) Offense OUI

·         Imprisonment for 60 days to 2½ years.  Must serve minimum of 30 days.

·         Fines range from $600-$10,000.

·         DMV suspends driver’s license.

·         License reinstatement costs $50-$1,200, depending on circumstances.

·         Mandatory installation of ignition interlock device.

Third (3rd) Offense OUI


·         Imprisonment for 180 days to 5 years.  Must serve minimum of 150 days.

·         Fines range from $1,000 to $15,000.

·         Eight (8) year license suspension.

·         Mandatory installation of ignition interlock device.

·         Alcohol education program.

·         Revocation of vehicle registrations.

·         DMV suspends driver’s license.

·         License reinstatement costs $50-$1,200, depending on circumstances.

Fourth (4th) Offense OUI


·         Imprisonment for 2 to 5 years.  Must serve minimum of 12 months.

·         Fines range from $1,500 to $25,000.

·         Ten (10) year license suspension.

·         Mandatory installation of ignition interlock device.

·         Alcohol education program.

·         Revocation of vehicle registrations.

·         Possible seizure and forfeiture of vehicle.

·         DMV suspends driver’s license.

·         License reinstatement costs $50-$1,200, depending on circumstances.

·         Mandatory installation of ignition interlock device.

Fifth (5th) Offense OUI

·         Imprisonment for 2½ to 5 years.  Must serve minimum of 24 months.

·         Fines range from $2,000 to $50,000.

·         Lifetime license revocation.

·         Mandatory installation of ignition interlock device.

·         Alcohol education program.

·         Revocation of vehicle registrations.

·         Possible seizure and forfeiture of vehicle.
